Legal Question in Personal Injury in Michigan

if a private company who is registered with the MDOT for limousine service employs a person or persons who participate in the use of Marijuana at home, transport car accident victims to their dr appointments and home daily, are involved in a vehicle accident with a company car and test positive for THC who is liable the company or the driver or BOTH? The company owner doesn't know his driver(s) use marijuana and it is not for medical use.
