Legal Question in Wills and Trusts in Michigan

contested will

My father in law died last year. Even though he and my husband never got along. Rick was told that he was removed from the will back in 1982. We have been told that on that day the father was arrested for drunken behavior outside of the courthouse. If he signed this will under the influence will it still be valid?

Re: contested will

The question is whether he had capacity when he signed. Being drunk does not invalidate a will.

Re: contested will

Did he sign the will in '82? What does it say? For the most part, being drunk does not invalidate a will. Contact me at www.kliszlaw.com to discuss further. Tim Klisz
