Legal Question in Wills and Trusts in Michigan

Who owns the land on my homestead certificate?

I have two Michigan homestead certificates from the 1870's in the names of two of my direct ancestors. I've also found copies of them online and it shows them in my great-great grandparent's names still and it says they're not cancelled. I'm curious who the land belongs to now, as my parents and I know nothing about the probate records on the property or what happened when they died. Where can I find out what's happened to the land? Is there any likelyhood we have rights to it, even though we haven't gone through any legal action and just have these documents? I hope I'm not being too vague! Thanks in advance for any help!

You would either have to do your own title search through the register of deeds (preferably with an attorney) or have a title search done by a title agency. The latter is less expensive and time-consuming. If you found you have a claim to the land, you would need to pursue it in court. You need to give this problem to a Michigan attorney and probably a title insurance officer to research the state of title. It sounds unlikely that you would have a claim, but you never know, it's worth some more investigation.

If you can't find a Michigan attorney, call us and I may be able to find you a referral.
