Legal Question in Workers Comp in Michigan

Is IME diagnosis the final one

I have chemical-induced asthma and COPD and neurological and liver problems from working with isocyanates. My work sent me to an IME who diagnosed me as having allergies. Then they put me out on a no work available personal medical. Two of my doctors stated this IME is well known and highly paid by the car company to dismiss cases like this. Is this IME report it? Can I get my own "third opinion?"

I am an attorney in Illinois so I do not know the specific laws of Michigan. However, there are several similaities in the Work Comp laws of each state. In some states, an IME is used as a permanency rating. I don't think this is the case in Michigan. The fact that you refer to this doctor as an "IME" idicates he is the company's doctor with his opinion. You may have the opinions of your treating doctors on your side but if they are not experts, their opinions may not hold up. You should get an opinion from an expert that hopefully will support your treating doctors opinions. These are a matter of "trial tactics." Those decisions are best left to a competent attorney. You don't say if you have a lawyer. If you don't, you should get one. You can't fight the insurance company by yourself. Good Luck.
