We had to let an employee go due to attendance problems he owed us money for a advance at the time he threatened us when he left if he took alll this money out of his last pay check since then we have had nothing but problems he signed a loan paper stating he would make bi weekly payments its been over 3 months and we have not gotten anything from him we are set to pay his IRA in April but we don't want to pay him this money since he still owes us money what are our legal obligations

I will need to review the "loan paper" he signed, but you will likely be able to offset obligations based on the amount due if the writing permits that.

Otherwise you will be required to enforce the loan as any other creditor (sue, obtain judgment, pursue collection thereof).
