Legal Question in Family Law in Minnesota

Real property

I am preparing the paperwork to file divorce from my husband. Our current home is going into foreclosure soon and we are both moving out into separate other residences and allowing the foreclosure to happen. Do I still list that property on the summons and petition when I file and have the papers served even though the foreclosure will have happened before the final court date?

Re: Real property

If you still own the property when at the time the summons and petition are served, then yes, you should list the property in the summons and petition.
