Condo Noise

Why is it that attorneys don't recommend to their development clients that they have covenants for noise forcing action by tenant/condo associations? We have done this for years in Minnesota, including demo CD's for developers to demonstrate noise quality and to have tenants and condo buyers sign off on that quality.

I would not say that such covenants are never recommended. I routinely provide a long list of suggested covenant topics to developer clients. Many of them are stricken by the developer client. While I can't speak with assurance about their motives, I think that the general motiviation is a belief that "excessive" covenants scare away potential buyers.
