Legal Question in Traffic Law in Minnesota

State - MN County - Hennepin

I rear ended a SUV during rush hour traffic. The driver admitted to slamming on her brakes. She veered to the left as did the car behind me. I was nearly able to avoid impact but did not. I was a failure to drive with due care citation. The adjuser reviewing my car determined that the damage showed a low speed impact. I realize that regardless of the situation the driver who rear ends is responsible but I feel that the citation was a bit over the top considering the circumstances. I would like to fight this, but am unsure if it would do any good. Any advice?

Those are tough to fight, and cops are usually instructed to give tickets at every accident. (They don't believe in circumstances that would lead to a pure accident and therefore someone must have broken the law)

If you want to fight the ticket you need to appear in court on the date given to you on the citation. Plead Not Guilty and ask for a trial. This can be done without a lawyer, but of course it always makes the process easier.
