Legal Question in Family Law in Mississippi

Can custodial dad get child support from birthmom if she don't work??

My husband and stepson's birth mom share joint legal custody with husband having primary physical custody.Birth mom lives in Arizona(24 hrs. away). Birth mom pays for plane ticket for stepson(13) to and from her house. It usually runs $300.00 round trip, 3 times a year. The first year sson came to live w/ us, BMom sent $10.00/ $20.00 once every couple months. That has stopped and bmom hasn't sent any money in over a year.Bmom does NOT have a job. Can we try to get child support from her.Do we have to go to court, or can our lawyer sent a letter to the judge? Will the judge even make Bmom pay cs if she doesn't work? If Bmom paid $55.00/wk(like husband pd her for 11 yrs) and we split the plane ticket w/ Bmom, we would still end up w/ plenty of extra money for sson, which is a teen and always needs money. Please help.We are afraid to go to court and judge just tell us ''sorry Bmom doesn't work, so you gat no cs''

When a person is represented by an attorney, it is a disservice to the client for another attorney to give him or her advice. Talk to your attorney about any questions you may have.
