Legal Question in Family Law in Mississippi

Wanting to get what's fair

My husband has a Minister's License. He has gotten a housing allowance for a couple of years. He has cheated on me several times and now I want a divorce.

We have 4 children, Ive never worked outside the Ministry and was married at 15 years old. We are seperating at this point. But now he is asking me to sign my name off the deed of the house because he says he cant afford to lose it and this way my credit wont be ruined if he loses the house. But here is the question.... Being a Minister can he legally do away with his housing allowance and turn our house into a parsonage to avoid paying me that percentage of his housing allowance. His housing allowance which is not taxable is $2800 a week and his salary is $1000. Can he legally do away with it to avoid giving me what is fair?

The thing to do is get an injunction against him. To do this you would need to bring a motion for an injunction to prohibit him from doing anything that would adversely affect you and the children and ask for temporary relief. Temporary meaning the time between the time you file and the time the judge finally signs off on the divorce. I have never addressed the issue of a minister's house allowance, but the judge would know how to handle it as far as what part of it you are entitled to. The judge's concern will be the wellbeing of the children.
