Time limits

How long do you have to file a suit if the malpractice was commited years ago but you found out only when you had surgery again

Various states have different time limits. In California, the time limit is within one year from the date the victim knew or should have known of the injury and the negligence that caused the injury. These time limits can be quit strict, and you should consult with an attorney in the state where you would be entitled to bring the lawsuit.
