Legal Question in Personal Injury in Mississippi

Offered settlement out of court.

Had offer to settle out of court on auto accident suit which occured 5 years ago. I've been trying to get case to court but attny puts me off. He said I'd have to pay my medical bills out of my settlement which he said would be $20,000. He gets half of course which leaves me $10,000. My medical bills is $5000 resulting from accident. I am still in pain and was told by doctor that my neck injury could cause me to be paralized within time. To suit was suppose to be for $250,000. I don't know if to accept that offer or not. Sounds like I'm getting the worst end of the deal just to drop the case. Could you recommend. I really don't want to settle for that but they may figure out another way to postpone the case. I living on nothing no and no insurance due to my job shutdown a year ago. Thanks.

Depending on many factors, the $20K could or could not be a fair settlement. The factors include (a) liability for the accident (who is at fault or if there is split liability); (b) county in which lawsuit is filed; (c) severity of injury (MRI report); (d) amount of other damages (lost wages, etc.); and (e) many other considerations.
