Wrongful Death Suite

My Father was killed resently in a car crash. His wife and 12 year old son are suing for wrongful death. They Are my step mom and younger half brother.

At the beginning of this I started a wrongful death suit on the other driver and the local fire dept. (For not haveing traffic directors out while they were fighting a field fire.) The smoke of the fire is what caused the other driver to merge into my fathers lane.

My questiion is that If my step mother wanted to get herself another attorny and have her and her son taken off my case would I still have my case???? Would I loose my wrongful death suit on my father and not get anything from his death?

You are a statutory wrongful death beneficiary and, therefore, are entitled to a statutory share of the recovery. In other words, the percentage of what you will receive is already set by law. All of the heirs can have different attorneys or can have the same attorney.
