Power of Attorney

I would like to know if a non blood relative that has been assigned as a Power of Attoney can claim CD's that were in blood relatives names that were POD?

The attorney-in-fact will have a heavy burden of persuasion to claim the CDs because he or she had fiduciary responsibilities to the principal during his or her life and which ended at the time the principle became incompetent or passed away.
