If you have been summoned to court and made arrangements but was unable to make payments due to an existing garnishment, can you still offer a settlement or be offered a settlement after payment arrangements have been made?

There are few if any legal restrictions on a plaintiff (credit card company) and a defendant (you) making multiple settlemnt/payment arrangements. If your incom e is reduced by a another garnishment, it is likely that the plaintiff;s attorneys will take this into consideration in deciding whether to accept slower or lower payments than were previously agreed. They may want to take judgment to protect their client's interests. If there was a payment plan in place and you missed payment(s) than you may be unable to prevent the plaintiff from seeking a judgment. Contact the plaintiff;s attorneys and try to make arrangments, if you do not think you have a defense to the claim sought. But first, it may be worth your time to have your own attorney look over the claim against you and any defenses you may have, to advise you as to your options and likelihood of success in court.
