fathers rights when mom moves out of state

Mother wanting to move out of state with ten month old daughter wanting to know fathers rights. Were never married he does not pay child support and nothing is written up about any kind of visitation. Wanting to know if he could file for visitation after we move.

Unless there has been a Court Oder of Paternity or at least a Division of Child Support administrative Order of Paternity, the man you refer to as the child's father is not the legal father of the child and has no rights whatsoever concerning that child. Either of you could file a Paternity suit on behalf of the child at any time. If you have moved out of state, and he then files such a suit, he will need to have you served wherever you are located, and you could then hire a local attorney where the suit is filed to represent you.
