Legal Question in Family Law in Missouri

What are fathers rights

I am wondering if my daughters mother has a right to only let me see her for 5 hours every other week. She refuses to set up a reasonable visitaton schedule because she's not ready to share our daughter on a more regular basis..

Re: What are fathers rights

You refer to "your daughter's mother". Does this mean that you chose not to get married before having a child with the woman? If so, then I do not know of any legal rights that you have regarding that child. Did you obtain a court Order determining you to be the legal father? Did you sign an affidavit of paternity and have your name added as "father" on the child's birth certificate. Even if you did, that doesn't mean that you have any specific rights either to make parenting decisions orspend time with the child. You may be able to do something about your situation legally if you hire an attorney to represent you and obtain some judicially determined rights. Good luck!

Re: What are fathers rights

As long as there is no question of parentage, and no court has issued a custody or visitation order, parents share the rights and responsibilities of their child. That includes spending time with the child.

If there is a support/visitation order, and you are paying support, and the mother is refusing to comply with a visitation order, you may be able to prevent the money from going to her until she complies. You would still have to pay if (to the court) but it usually gets the mother's attention when the support stops.

Good Luck
