Legal Question in Family Law in Missouri

Is it legal for me to take my daughter out of state if we do not have a parenting plan or any custody established? Her father is on the birth certificate but was in prison for the last 5 years but just returned home in jan.2012. I will be moving from missouri to colorado but dont want to leave my daughter behind. Can i get in trouble for taking her without his consent?

Since you do not have a formal custody or support Order in place, you will probably be okay by sending the father written notice of your intention to move 60 days before you move Keep a photocopy of what you send, for your files, as you may have to get child support some day. With written notice, he will have a harder time contesting an Order to pay support to Colorado, based upon your move. If you are moving in less than 60 days, send him notice as soon as posible.
