Legal Question in Family Law in Missouri

MO Name change law and how to petition

I am looking for information the name change law for a minor in MO. We have not see or heard from my son's father in over 2 years and do not know his where he is. And son wants to change last name to my maiden name.

Could someone tell me what the MO law is on this and how to petition. Court clerk told me that I could not file unless I had ex's permission, but not knowing where he is, I can not get permission?

Any help would be appreciated.

Thank You.

Re: MO Name change law and how to petition

The clerk was correct. You would need to get consent of or notice to the father before name change. If you cannot locate him, you will need to get service upon him another way. At this point you should probably hire an attorney to handle this for you, as it could cause problems for the child later, if it is done wrong.

Good Luck
