If I have a baby while married with someone other than my spouse who is legally the father? Am I legally obligated to let the biological father see the baby? Or is my husband automatically the father?

There is a presumption that your husband is the father. However, if the natural father of the child files a paternity action he can ask to be named the biological father, request custody and a parenting plan and have other issues settled. If you were to dissolve your current marriage, and your husband tells the court that the child is not his, then the natural father would have to be joined in your dissolution action.
