Legal Question in Family Law in Missouri

I am seperated, but not divorced. I was laid off from my job back in November of 2008 and wasn't employeed again until April of 2009. In that time my soon to be exwife filed child support papers against me. The problem is I don't make nearly the money I used to make and my child support was based on previous wages. Every week when I get paid, half of my check is taken for child support and I am left with very little money. The amount taken doesn't even cover my child support and every week I get deeper in the hole. I've had to move in with my parents just to survive. I rarely see my children, yet there is no custody order. I have called the child support offices but am told there is nothing I can do. I am at a loss here and don't know what to do.

You should contact an attorney and discuss the possibly of filing a motion to modify your child support and a dissolution of your marriage. From what you say, neither of you have filed for a dissolution of your marriage. When that happens you will discuss the child support issues, custody, a parenting plan, and division of your marital assets and debts. Until the child support order is modified you will continue to have your current wage assignment.
