Legal Question in Family Law in Missouri

I have a son who just turned 6 last december (2015) when he was born his father was not there. he did not get put on the birth cert. he didn't even meet him til he was 2 months old. then on father's day 2010 he asked to take my son for the weekend. I agreed. and he disapeared with him. i've found him 3 times and shortly after I do he vanishes again. I have found him a 4th time. He had a paternity test done and was added to the birth cert by administrative order and was ordered to pay child support the month before he took off with our son. we were never married and there has been nothing filed through the court to establish custody. i want to go pick up my son from school before his dad leaves with him and it takes me a year to find him again. do i have the right to do so? i have a family member who is an office manager for the probate court in my county. she has searched in every corner she can and can't find any thing filed by the father to establish custody. he has even taken my son and hidden in Kansas for a while. now he is back in missouri.

"Taking" a child not advised. If the child has been living with Dad for some time, it m might be harsh to uproot him abruptly. First have your attorney be prepared to immediately file a request for a custody and visitation Order. Obviously, you and the father do not cooperate well (you didn't even give his name for the birth certificate). If you two just take turns running with the child, you run the risk that a judge will put the child into State custody. Find a family law attorney in your area. Take all your relevant documents, and assist them in making a custody plan for you.

Good luck
