Legal Question in Civil Litigation in Missouri

My son was in a relationship for 5 years and engaged for 3 of those years. His fiance just left him. Since she is the one who left, is he entitled to get the engagement ring back? I've heard that her accepting the ring and proposal means she has entered a contract and since she is the one who voided the contract, the ring should come back to him, but I would like to confirm if that is the case.

In almost every case taht I know of, courts have required former fiances to return engagement rings when the engagement ends, or pay the value of the ring. That is, if theri fiance paid for the ring all by them self, and ot through some sort of joint credit card or jeweler financing. It might just take a single letter from an attorney to get this gal to do the right thing.

For most of the thirty-three years I have been practicing law an engagement ring was considered a gift and not recoverable if the engagement was broken off. But just a very few years ago, the Missouri courts have changed the law to hold that the giving of an engagement ring is a conditional gift and if the person receiving the ring breaks off the engagement then the ring or its value may be recovered. I have sucessfully obtained relief by filing suit and I would be happy to discuss this further with you if you ar enot already represented by an attorney.
