Legal Question in Insurance Law in Missouri

death benefits

My ex husband was murdered by a woman he married . It was a murder for hire. she is in jail awaiting trial. My ex father in law was listed as the secondary beneficiary of all the life insurance policies she took out. 1.2 million dollars. I have the 12 year old son of the deceased. Does he have any right to the insurance money should she be convicted or does it rely solely on the generosity of the ex father in law?

Re: death benefits

The insurance benefits would go to your ex father-in-law under the insurance contract if the wife is disqualified as a beneficiary upon being convicted. That money will not pass through any probate estate of the deceased, and will not be subject to any claim by the son. As the child's mother, you might approach the ex father-in-law with a request that he put some of that money into a trust for his grandson, but what he does with the money will be up to him.
