Legal Question in Personal Injury in Missouri

Okay this might be a tough one to answer. Last summer i was playing in a basketball game in a opposing high schools gym. Not more that 6 feet away from the court was a big rebounding device thats called "The Gun". There wasn't any concern about it until the ball was going out of bounds and i dove to save it and my arm went under this device and i broke the growth plate in my elbow. I had to have surgery about a week later and had two screws put in that are never going to come out of my arm. My right elbow ( the one i injured and im also right handed) is and will always be swollen from this accident. I cant rest my right arm on a table or keep it bent for a long time or it will get sore when i extend it again. We've talked to a lawyer about this but i thought i'd get some info myself. Obviously were looking for some money from this since this injury will affect me for the rest of my life. The question is what is a reasonable amount of money we should ask? Minimum and maximum? thanks

I am sorry to hear about your injury. Under Missouri law, you will have an up hill battle bringing any claim against the school because you voluntarily accepted the inherent risks of engaging in paying basketball, which obviously includes breaking your arm. If you can past this, you will also be up against defenses such as the Gun was "open and obvious" to anyone who cared to look. Overall, this is a case that an experienced Missouri personal injury lawyer would not take. Hopefully you have health insurance to cover your medical expenses.
