Legal Question in Real Estate Law in Missouri

Foreclosure Procedures

What is the law in Missouri for vacating property that was foreclosed on and if the individual has had a physical injury to themselves will the judge in court usually extend the time an additional 30 days from the court date to vacate if there is a doctors note stating that the person can not lift over 20 lbs?

Re: Foreclosure Procedures

The action that Plaintiff's often file is an unlawful detainer action. It is a request for the Court to tell the Defendant that they have remained in aproperty beyond the period they were allowed to. If the Court issues the Order, there is little that can be done through the Court to extend the time for the Sheriff to put the stuff out.

However, there are often deals that are made between the Defendant and Plaintiff. If the Plaintiff has an attorney, they can, but are not required to, make arrangments to monitor the steady vacation of the property. Many items weigh less than 20 lbs, and there are many moving companies that can move property for the person being evicted.

Good Luck
