Legal Question in Real Estate Law in Missouri

Property Rights

For 30 years, I have improved on and have out buildings on property which Missori Dept. Of Transportation and the city of Park Hills are surveying as their land (a portion of the property in question is marked as an ''alley'' in a previous survey). No one has put claim to this land or made use of it before last year, however, there is now a state park which adjoins the property.

I would like to know what my rights are.

Thank you.

Re: Property Rights

It sounds like you may be talking about a situation in which you may have a claim to the real estate under the theory of "adverse possession" even if the actual recorded ownership is with someone else. Of course, you would need to pursue this claim through a lawsuit in which the circuit court in the county in which the property is located would determine the issues and perhaps quiet title to the property in your name. Please be sure to consult with an experienced real estate attorney in your area without further delay. Good luck.
