Shared well rights?

Short version: Parents bought a home, were told neighbor owned 1/3 of well? No documents, no record at assessors and now the neighbor has put in a pool and lawn sprinklers... Neighbor is not cooperating to draw up a shared well agreement? what's parents recourse? Thanks David

There may be an agreement at the recorder of deeds office. look there first then let me know what it says.
