Legal Question in Wills and Trusts in Missouri

Deceased with no will.

My father passed away and did not have a will. He is survived by his wife, two sons and myself. My half brother closed my father's banking accounts before his death. My step-mother believes that she can deed the farms to her two son's from another marriage. I am my father's oldest child. I do not live in Missouri.

What did the deed to the farm say? Did your father and his wife own the farm as joint tenants? If so, she owned the farm upon his death and can deed it to whoever she wants. If your father's name alone was on the deed, then the property will have to be probated. His wife will be entitled to a share of ay probate assets as will your father's surviving heirs at law. I would suggest tat you hire an attorney in the county where the farm is located to represent you and advise you specifically concerning your rights.

Where did your dad die? Where was the property located? Did your dad acquire the property before or after the marriage?
