my mother died a few years ago my stepfather wants nothing to do with us they were married for 20 yrs. he has a will with his children only do we have any rights

At the time of her death, unless her will said otherwise, your mother's assets were to be split between your stepfather and you. It is probably too late to open an estate for your mother. But, you might be able to file a Motion to Determination Heirship as to some of her asets. You might consutl directly with a probate attorney in yoru area. He can discuss yrou mother's assets with you to help you determine if any are worth pursuing.
