Father died 4 years ago. Mother just died.

Two sons named as beneficiaries in the parents

Will. One son had no contact for 15 years now wants

his share. The other son had POA and is the

executor of the estate. A Beneficiary Deed was recorded after father died naming only one son.

A small bank account was jointly owned by that one

son and the mother. Are the property and the bank

account covered by the Will which calls for an

equal split of the estate.

The real estate should pass to the beneficiary on the deed. The bank account should pass to the surviving joint tenant. The other assets of the estate are likely to be probated and divided one-half to each son according to the will's terms.
