Legal Question in Civil Litigation in Montana

vandalism by a minor

My car was ''keyed''/scratched up by an 8 yr old boy and he had a friend (8 also) with him who suggested they do it, was there for the incident and then ran off. The boy who ran off scratched another car in the same driveway (my daughter's home on an AFB - proprietary property) and that was less than a year ago. The base police responded, did not call the sheriff whose juridiction it was and come to find out the boy who ran off has a dad who is a base policeman! One boy confessed and his parents agreed to pay our deductible. Now they do not want to pay. We are leaving to go home to FL on Monday and it appears they are waiting for us to leave and take our deductible to another state. What can we do?

Local civil servants (ie., police, sheriff's marshall's,courts etc.,) ordinarily have little authority to compel military personnel, to do anything.

Therefore, suggest that you schedule a meeting with the Base Police Commander, to formally submit your information and request for redress.

A Commander can demand his/her personnel comply with demands for debt payment and other obligations or responsibilities re these kind of matters.

Alternatively, you might also file your claims in Small Claims court.
