Legal Question in Wills and Trusts in Montana

An Easy Estate Settlement, But Now To The Brass Tacks!

My husband is the executor of his father's estate. Most is easily taken care of because bank CD's, life insurance, savings bonds and IRA's list the children as beneficiaries. But the hard part is breaking up a collection that his father had plus 2 vehicles have grown children listed on the titles with the 2nd wife. (they were married 4 years and she wants it all.)

Wanting to work this out smoothly, how can my husband, as executor, split up the collection with the siblings and step-mother and work out the dealings with the vehicles?

You don't say what state you're in but some states have statutes that prevent 2nd wives where the husband has adult children from getting all. If, however, you can't work it out peacefully, you may have to file a formal probate. I think it best to consult with a local attorney in your area because this seems more of a personality dispute than a legal one although the legal system (won't call it "justice") may be able to help.
