Sister died with no will

My sister died without leaving a will. She has a minimal amount of money in a bank account, less than $10,000. She was legally married though they've been living with others and not together for 15+ years and she has one son that doesn't want anything to do with her. What do I need to do to get access to this account or can I and if not, who can and how?

You have no right to the money. If first goes to the husband, and if not him, to your nephew. Either of them will have to make a claim with the bank to get to the account. Or, you could request to be appointed her personal representative which involves giving notice to her husband and son.
