Legal Question in Credit and Debt Law in Nebraska
Collection on Medical bill
My husband has been making $150.00 payments to a collection agency monthly. The are requsting a balloon payment of $1160.00 by the end of this month. They told me this must be paid or they will seek litigation. Is this a fair and legal practice. I thought if we showed an effort to pay they could not do this.

Re: Collection on Medical bill
As long as you don't dispute that your husband owes the debt and has no defense to it, a demand by a creditor (including collection agency) for payment in full of a delinquent amount is legal. The debt collector is bound by the Fair Debt Collection Practice Act so you can look to that for whether there are any other debt collection violations, but demand of payment in full of a valid debt is not a violation.
