Legal Question in Technology Law in Nevada

Website name in competitor's source code

A friend of mine is a real estate agent that spends a lot of money to get higher ranking on search engines. Several competing agents have incorporated his URL in their source code so that when people google search his name/url that they also are returned. Since his url and name are unique to him and since they are incorporating it into their website code (not just linking but in the page code) in order capture traffic intended for him, does he have any recorse against these individuals? Effectively they are using his name/url without his permission.

Thanks in advance.

Re: Website name in competitor's source code

You are correct. Claims for infringement based on unauthorized incorporation of TMs in source code or metatags have been successfully asserted. A strongly, properly worded Cease and Desist letter from an attorney will likely take care of the matter.
