collection

i was a secondary on an account with my brother in 1996/ he filed for bankruptcy in 1998. i am currently being sued for that debt. am i liable for a debt that was discharged in bankruptcie?

If you have been sued, you will be found liable, unless you timely file with the court and serve opposing counsel, with a response, setting forth your affirmative defenses. Your attorney can explain further.

One of your defenses is the statute of limitation, which in Nevada is 6 years. Since it is 9 years from the date of the bankruptcy, I am sure you have that defense.

If you are not represented, I would do it relatively cheaply and would get your legal fees back.
