annulment

if i got married las vegas a year ago, is that too long ago to get an annulment? if not-how do i get an annulment?

Thank you for your question regarding a possible annulment.

Unfortunately, Minnesota does not have a proceeding for an annulment. Regardless of the duration of your marriage, your marriage can only be ended by a divorce. If your spouse lives in another state where an annulment is recognized as an alternative to a divorce, perhaps he or she could file in that state. However, if you wish to end your marriage, your only option is to commence a divorce proceeding.

If your spouse does not live in Minnesota, the divorce can still be done in this state�provided you are a resident of Minnesota. The court would have jurisdiction over your marriage relationship and could grant a divorce. However, if your spouse does not live in Minnesota, or has property outside Minnesota, the Minnesota court could not grant spousal maintenance or dispose of property from another jurisdiction.

I assume that you do not have children and that you have accumulated little property together during the term of your marriage. Perhaps you have even lived apart for some period of time, and all you are really interested in is dissolving your marriage. If so, a divorce could be relatively simple.

Nevada law does have annulments. The issue is (1) when did you separate from your wife (2) why did you wait a year. Unless you have a good reason for waiting, the judge may not grant the annulment and you might be stuck with a divorce.
