divorce

my signature was forged on a divorce decree and its been filed for 4 yrs is my divorce legal

Thank you for your inquiry.

If you are able to show that your divorce decree was forged it would be a void agreement. A Court would still consider you to be divorced but you would need to re-address issues of support and custody.

Fraud is a difficult thing to prove so you would need to have clear and convincing evidence of said fraud to effectively bring a Petition before the Court. I would like to speak to you a little more in-depth to discuss what issues are in play regarding your divorce.

No, if you just recently learned of the forgery. I litigated this a year ago with a forgery of over 15 years ago and won. Fraud is fraud, no longer how long ago, the issue is when did you learn about it and what did you do.

Until you file a motion to set it aside it is legal. You have two years from the time of discovery of the forgery to do so, otherwise it stands despite the forgery.
