Legal Question in Family Law in Nevada

want to move to my country New ZEaland

I have 2 kids...one 14 who is already living in New Zealand and one 4yrs who is with me...I was never married ..the dad of the kids is an alcoholic and abusive to my 14 yr old...that is why she is in New ZEaland....we are in court now and have had some court appearances...I have been representing myself and I am a starving nursing student....

we cant agree so we are going to trial on may 12th....

my question is....

can I dismiss the case now and go to new zealand with my 4yr old as there would be no legal custody decision yet...and the kids dad has an attorney but has run out of money to pay him and owes him money....so he wouldnt even be able to get a lawyer to get us back......I finish school in 3 months and then want to do.....we were told to just dismiss the case and go....what do you think....

You cannot unilaterally dismiss a custody case. You need either a court order or the consent of the father to dismiss it. If you leave the country and take the child without permission this is a felony.
