Legal Question in Family Law in Nevada

NV CPS bullying grandparent to adopt

My Mom, 64, was given temp placement of my niece, now 16 mos, due to her mother doing meth while pregnant. My Mom has also had guardianship of my 14 yr old nephew for 13 years now-same brother, different ''mothers''. I'm 47 and moved in with mom to help with my niece-initially for the 6 months it would take the parents to get their daughter back, but now they have a trial date in Nov to contest TPR. CPS pushed us to go for the foster care license and after immense hoop-jumping, we withdrew the app when they frowned on our family ''situation''-Mom's been married 4 times (20 yrs to her last husband before he died) and I have Hep C (from a transfusion in 1979). With the parents failing at their plan-not working, still partying, living with ''friends'' whose backgrounds are more like criminal records, the stress caused my mom a severe arthritis attack and landed her in the hospital for 4 days. An hour after she got home, CPS calls her and says I diluted my urine sample and I would have to move out or they would come get my niece. I told her my impaired kidney function was why. I said my hair test was neg, right? She says she didn't even look at that. Mom wants guardianship, not adoption-but CPS says no she's too young they want adoption???

Re: NV CPS bullying grandparent to adopt

Thank you for your inquiry.

If CPS is attempting to terminate the parental rights of their natural parents due to their poor lifestyles; your grandmother will have to do a formal adoption of the children. If Grandma does not want to adopt the children, CPS has the right to continue with their adoption proceedings placing the children into foster care.

It really is up to Grandma on what role she would wish to place with the kids. I would HIGHLY RECOMMEND that you hire an attorney to get involved with this case.

My office handles all types of family law matters including adoptions. Contact us if you'd like to discuss your case further as we do offer payment plans in most cases.

Re: NV CPS bullying grandparent to adopt

She should hire a lawyer or else the adoption is going to happen. The County will file a petition to terminate her parental rights and without a lawyer, she is sure to lose. I have done approximately 20 of these trials and would charge $5,000 to represent her.
