Legal Question in Family Law in New Hampshire

Last Name Issue

I am a divorced father of two children, ages 13 and 17.5. My divorce was final 7 years ago and I have visitation every other weekend and pay child support on time every month, never late, never missed a payment. My ex-wife just gave birth to a child and is unclear who the father is. It is definately not me, I have not been intimate with her for over eight years. She gave the newborn my last name because she wants all of her children to have the same last name, she never changed her name after the divorce. What are my liabilities? Should I demand a paternity test in order to protect myself from future problems. My current fiancee is very concerned with this recent event and feels we could become responsible for support down the road or the child could end up with the same inheritance rights as my biological children.

You do not assume any liabilities absent being the parent; last names do not impute paternity, especially here where the mother kept that name after the divorce. If you are concerned with inheritance issues, please contact me and my office can assist you in drafting a will and estate plan.
