Legal Question in Family Law in New Hampshire

Moving with child

This is the mother of a child; child's father barely involved in 7 month old's life. Mother wishes to move to California to be with her boyfriend who is a stationed marine. Father of child is now threatening to make things difficult for mother and child to move. What needs to happen in order for my son and I to be able to move.

You do not indicate if you are married to the father. In that case, it would seem a divorce would be appropriate to deal with child raising issues. If you are unwed, then you'd still need to petition the court for determination of appropriate "Parenting rights and responsibilities." The court would likely appoint a Guardian ad Litem to represent the interests of the child and would make a recommendation to the court as to appropriate care and support.

The court will need to determine if the move will be beneficial for the child when contrasted with his distance from his father. I'm making this as simple as possible. The real analysis is a bit more complex.

These can be very challenging legal proceedings. You would likely benefit from the assistance of an attorney in the process.

As indicated by Attorney Dorner, further details are needed to answer this question- including but not limited to your current marital status; however, even with that being said, I would not move an infant to California without being wed to the Marine given the chances of deployments and other distractions that they may encounter- which will affect not only you, but more importantly your child- which any Marine clearly would understand.
