Auto Insurance Settlement Disagreement

A tree fell on my car that was parked in my driveway. The insurance company has placed a value of $3600 on my car and their adjuster has declared that the cost to repair the car is $4000. As a result, the insurance company wants to declare the car a total loss. If I can get the car repaired for less than the value of the car ($3600), is the insurance company obliged to pay for the repair?

You should have the car appraised on your own - look in the Auto Trader, Kelly Blue Book, Sunday classifieds, etc. Do not take the insurer's value just because they say so - get a copy of their appraisal.

You may be able to have the repair work done for less than the value if you persist.

Was it your tree? A neighbor's tree? If not yours, you may have a liability claim against the neighbor and have your car repaired that way.
