mold

I moved into an apartment with my elderly parents Oct 07..

I have noticed a diffrence in them and myself with symptoms of mold exposure. i have been more ill than my parents.although we have no visable signs of mold growth. I purchased a mold kit to test, after radon,aspestos,carbon came up negetive.. Well as you can guess it tested positive for mold.. landlord saying its all in my head,even though he has seen the positive mold test... he wants me to continue my lease, i want to find another place for my parents and myself. whats my legal righs? am i forced to live here feeling my parents health is in jeporedy as well as my own?

While your rent is current I would suggest you file a complaint with the building and/or health department of the municipality. They will generally investigate and advise if there is a serious health issue. If they confirm your belief, you would then have grounds to terminate the lease or compel the landlord to take corrective action.

There are other options, and you may wish to consult with an attorney who can examine all the facts and circumstances of your case to advise you in greater detail.
