Legal Question in Landlord & Tenant Law in New Hampshire

Stop payment on a check

If I stopped payment on a check can the landlord go to the police station and have a warrent issued. And shouldnt a demand for payment be written. Does the officer have the right to call me and give me a set time to get the money to the landlord. or tell me he will file an arrest warrent for my arrest?

Re: Stop payment on a check

There are many reasons to issue a stop payment order on a check. In this case the reason has not been stated. If the reason arose after the check was issued, did you notify the payee promptly of the dispute?

Was there enough money in the account at the time the check was issued to cover the check?

Did the payee know that the check had a stop-payment order or just that it did not clear the bank?

Often the police will make a courtesy phone call in the hope that both parties will work out the matter before it requires law enforcement action. In this case I'd need to know why the officer thinks that issuance of a warrant would be appropriate.

You would likely benefit from meeting with an attorney to review all the facts and circumstances. Depending upon the amount of the check and the conditions around the stop payment there is some risk of serious criminal charges.
