Should I seek legal advice?
I was rear endend at a stop light in an automoble accident in January. I had neck injurys and went through weeks of Physical Therapy and finally felt relief. With in days/weeks of finnishing PT got rear ende again at a stop lignt and suffered more neck and back pain.. I have gone through more PT with little or no relief from pain. The first one is ready to make a settlement, but im no sure what to do. Could the second accident blame my injurys on the first one? Both of the claims or out of the same insurance company and im not sure what to do? Any advice would be helpful.

Don't even think of settling without legal advice. There is little doubt the insurance company will try to offset one of your claims with the other.

The short answer is yes--legal advice would help you.
You are right to be worried that the insurance company will try to short-change you. They always try to blame something else when it comes time to compensate you for the harm caused by their insured.
Technically, in each accident you should be paid for the harm caused. (The first, from healthy to injured; the second, from fragile to worse.)
If both wrongful drivers are insured by the same insurance company, you have a chance to wrap up both at once for the full value of your harm, and let the insurance company decide how much to allocate to which accident.
