Do I have a case

I purchesed a new home in Feb 2003. For the past two years we started to notice carpenter ants so we self treated they came back last year and we finally called out an exterminator the came out the other day when he pulled off the insulation from the wall in my basement he found my wall covered in mold and fungus as well as a whole colony of ants. Can I go after the builder, something obviously is not right my walls should not have molded and we found a 1 inch gap between the sub floor and the wall? This is something that was covered up by insulation and siding. Please help

Frankly, it is not feasible to obtain legal advice concerning a specific case via an open web forum. You do not want to reveal confidences nor lose the protection of attorney client privilege by discussing a matter on an open forum such as this.

As far as general principles are concerned, the passage of time tends to erode legal rights, as do the terms of a limited warranty and or contract. There is a certain assumption of risk on the part of a Buyer, which can in part be reduced by appropriate inspections. Having said that, it would be important to look at the contracts and agreements you signed, as well as any law applicable to new home construction. You may wish to consult with an attorney.
