Legal Question in Real Estate Law in New Hampshire

home inspection

I sold my house in Feb.2003,the people who bought our house opted not to have a home inspection done (its clearly stated in the purchase and sales agreement)we are currently in civil litigation over some property left behind, the buyers are countersuing that we didn't disclose water seepage under a deck on the back of the house.I had no knowledge of any water damege at the time of the sale.Century 21 brokered the deal,the purchase and sales agreement clearly states that if you opt not to have the home inspection done you are buying the house as you see it.Is this a binding contract, and should I hire an attorney to represent us in court.

Simple answer is yes. Just because they did not have an inspection does not mean that you could not be found liable for fraudulent or negligent misrepresentation.
