Last will and testament

Can we draw up a mutual will for

married couple with adult children and if

one dies first will this be cumbersome to

handle?

I am unsure how you define "mutual will." Generally each individual has his or her own will. There may be similar provisions for the disposition of assets. Often, with well drafted wills there is no need for probate when the first of a married couple dies.

This area is a bit more complicated depending upon family structure and the nature and scope of assets and liabilities. It is best for you to consult with an attorney who practices in this area. Remember, drafting a will is only the first step. Probating a poorly drafted will is quite a chore.
